The Facts

  • A federal judge in Texas on Thursday temporarily blocked the Biden admin's attempt to end the Trump-era Migrant Protection Protocols (MPP), which require migrants to remain in Mexico to await their asylum hearings in immigration court.

  • This ruling follows a 5-4 SCOTUS decision in June that said the president had the discretion to end the so-called "Remain in Mexico" program, though the high court sent the case back to the lower court to consider whether his attempts to end it followed the Administrative Procedure Act.

The Spin

Republican narrative

DHS failed to implement the measures needed to ensure the government could detain migrants as they await asylum hearings without MPP, and states like Texas have been forced to deal with the overwhelming number of illegals crossing the border. MPP must stay in place until the Feds do their job.

Democratic narrative

MPP is one of the worst Trump-era policies, putting thousands of asylum seekers at risk while they await processing near the ever-dangerous Southern border. The cruel policy never suppressed migration, nor did it weaken cartels and smugglers, and repealing it should be an easy decision to make.
