  • New York Governor Kathy Hochul and Attorney General Letitia James announced on Friday that the state has sued prediction market platform Kalshi on the grounds that the company allegedly runs an illegal, unlicensed gambling operation in New York.
  • The lawsuit alleges, among other things, that Kalshi offers gambling products "under the guise of 'event contracts' on a 'prediction market'" without a state license, avoiding financial and legal consequences.
  • The state seeks up to $36 billion in damages, including fines equal to three times Kalshi's gains stemming from the alleged illegal practices, a $100,000 penalty for each attempt to offer sports wagering and mobile sports wagering in New York and full restitution to users.

Prediction markets like Kalshi are gambling operations disguised in financial jargon, and New York is right to hold them accountable. Kalshi lets minors bet, skips out on taxes that fund schools and addiction treatment, and diverts over $1.2 billion in gaming tax revenue away from communities. No federal label changes what this actually is: an unlicensed gambling ring exploiting a regulatory loophole at the public's expense.

Kalshi operates under full federal CFTC oversight, and New York's lawsuit is a naked attempt to muscle out a competitor that won't pay Albany its cut. Existing laws already cover fraud, money laundering and insider trading on prediction markets: no state crackdown is needed. Banning these platforms outright would be a massive overreaction that kills a valuable, legitimately regulated marketplace.
