New York judge strikes down state mask mandate
NBCOct 05, 2021
Supreme Court judge J. Rademaker ruled on Monday that a state-wide mandate for face masks in indoor public spaces was unconstitutional.
NY Gov. Kathy Hochul, a Democrat, reintroduced the mandate in Dec. 2021 after state COVID cases began to soar.
There could be irreparable harm to public health if masks are no longer mandated at a time when NY is still grappling with Omicron. J. Miller made the right decision to grant a stay until Gov. Hochul can appeal her case on Friday.
J. Rademaker was right to deem the mask mandate unlawful and unconstitutional. Hochul and the Dept. of Ed. tried to create confusion by lying about the motion to stay before it was granted.
