Judge Rules DOJ Unlawfully Fired Maurene Comey
Was firing Comey a case of illegal political payback or is forcing her reinstatement judicial overreach?

The Facts
- A federal judge ruled Monday that the U.S. Dept. of Justice (DOJ) unlawfully fired Maurene Comey, the daughter of former FBI Director James Comey, from the U.S. attorney's office in Manhattan. U.S. District Judge Jesse Furman ordered her to be retroactively reinstated.
- Furman granted Comey back pay from her July 16, 2025, firing through Dec. 20, when she started a new job. The judge also restored pension benefits for that span and ordered Comey's personnel file updated to show she resigned. Comey joined the firm Patterson Belknap this year.
- In a 55-page opinion, Furman rejected the argument that Article II gives the president unrestricted removal power, saying that the department advanced a "sweeping and unprecedented theory of executive authority." He found that the DOJ had violated civil service law. Comey's lawsuit had cited President Donald Trump's animus toward her father as a reason her firing was illegal.

The Spin
Anti-Trump narrative
Comey deserved to be reinstated since she was only fired because her last name annoys Trump. Civil service protections exist precisely to stop political payback from gutting the DOJ, and ignoring those rules would turn federal law enforcement into a personal grudge squad. Back pay and a clean record are the bare minimum she should receive.
Pro-Trump narrative
An activist judge has struck again, and this ruling should be appealed until it's overturned. Executive power, including control of prosecutors, belongs to the president and forcing taxpayer-funded paychecks and reinstatement is a miscarriage of justice against the Trump administration and another case of judicial overreach.
